Terms of Service

Template / draft — not legal advice. Replace the bracketed placeholders and have a qualified lawyer review this before publishing, especially the consumer-law and liability clauses for the German/EU market.
1. Provider
These Terms govern your use of the websites, the VibePlugin software, and the paid digital products (cloud generation credits and lifetime license keys) offered by:
Elena Hertel — 1ln Software Development
Raderberger Str. 160 c · 50968 Köln · Germany
E-mail: elena.hertel1986@gmail.com
Full provider details are in the Impressum.
2. Seller of record (Paddle)
Our order process and payments are conducted by our online reseller Paddle.com Market Ltd, which is the Merchant of Record for all purchases. Paddle handles the transaction, invoicing, and applicable sales tax/VAT, and provides customer service for billing questions. Your purchase is therefore additionally subject to Paddle's buyer terms and privacy policy at paddle.com/legal/checkout-buyer-terms.
3. The products
- Cloud credits ("tokens"). Prepaid units consumed when you run AI generation through the service. Usage is metered against real model token consumption; the credit cost of a given generation is not fixed in advance.
- Lifetime license. A key that removes the plugin's reminder notice; usable on up to five (5) machines per the in-product terms. Activating a further machine beyond the limit releases the least-recently-used activation.
The VibePlugin plugin software itself is open source under AGPL-3.0; these Terms govern the paid service and license keys, not the open-source code.
4. Accounts
Credits and licenses are tied to the e-mail address used at checkout. You are responsible for keeping access to that mailbox and for activity under your account. Use the same e-mail in the plugin's Account panel to access what you bought.
5. Prices and payment
Prices are shown at checkout in the stated currency and, where applicable, include or add VAT/sales tax as determined and collected by Paddle. Payment is due at purchase through Paddle's checkout. We do not receive or store your card details.
6. Credits
Credits are prepaid, personal, and non-transferable. They are not a means of payment, carry no interest, and are not redeemable for cash except where mandatory law requires. Credits do not expire unless stated at purchase. We may correct balance errors caused by technical faults.
7. Acceptable use
You agree not to use the service unlawfully, to generate content that infringes third-party rights or violates applicable law, to abuse, overload, or attempt to circumvent metering or security, or to resell access without permission. We may suspend accounts that breach these Terms.
8. Availability and "as is"
The service and AI-generated output are provided "as is". AI output may be inaccurate, non-functional, or unsuitable for a particular purpose; you are responsible for reviewing it before use. We may modify, suspend, or discontinue parts of the service, giving reasonable notice where practicable.
9. Right of withdrawal / refunds
Consumers in the EU have a statutory 14-day right of withdrawal for distance contracts, subject to the exception for digital content that has begun with your express consent. Details and our voluntary refund handling are in the Refund Policy.
10. Limitation of liability
We are liable without limitation for intent and gross negligence, and for injury to life, body, or health, as well as under the German Product Liability Act and to the extent of any guarantee given. For slight negligence we are liable only for breach of an essential contractual obligation (cardinal duty), and then limited to the foreseeable, contract-typical damage. Any further liability is excluded. Mandatory statutory consumer rights remain unaffected.
11. Changes to these Terms
We may update these Terms for valid reasons (e.g. legal changes or new features). The version in force at the time of your purchase applies to that purchase. Material changes will be announced on this page.
12. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you additionally enjoy the mandatory protections of the law of your country of residence. Place of jurisdiction, where permitted, is Köln, Germany.
13. Contact
